Terms & Conditions

• "Service" refers to the guided kayaking expeditions and related activities offered by Horizique.
• "Participant" refers to any individual who books or participates in our expeditions.
• "Agreement" refers to these Terms and Conditions accepted upon booking.
• "We," "Us," "Our" refers to Horizique, a kayaking expedition service provider based in Penang, Malaysia.

By submitting a booking request, you make an offer to contract with us for the specified expedition. Your booking becomes confirmed when:

• We send you a written booking confirmation via email
• You have paid the required deposit or full payment
• You confirm your acceptance of these Terms and Conditions

You must be at least 18 years old to make a booking. If booking for minors, you accept responsibility for their participation and agreement to these terms.

We provide guided kayaking expeditions in Langkawi's mangrove and marine environments, including:

• Half-day Kilim Geoforest Paddle
• Two-day Mangrove and Marine Experience
• Five-day Langkawi Nature Circuit

Each expedition includes the services, equipment, meals, and accommodations specified in the expedition description. We reserve the right to make reasonable modifications to routes, schedules, or activities based on weather conditions, safety considerations, or operational requirements.

Pricing: All prices are quoted in Malaysian Ringgit (MYR) and are subject to change until booking confirmation. Prices include:

• Guided kayaking services
• All specified equipment rental
• Meals as described in expedition details
• Accommodations for multi-day expeditions
• Transportation as specified

Payment Terms:

• Half-day expeditions: Full payment required at booking
• Multi-day expeditions: 50% deposit required at booking, balance due 14 days before departure
• Accepted payment methods: Bank transfer, credit card, online payment gateways

Participant Cancellations:

• More than 30 days before departure: Full refund minus 10% administrative fee
• 15-30 days before departure: 50% refund of total booking amount
• Less than 15 days before departure: No refund

Horizique Cancellations: We reserve the right to cancel expeditions due to insufficient bookings, weather conditions, or safety concerns. In such cases, you will receive a full refund or the option to reschedule to an alternative date.

Force Majeure: Neither party is liable for cancellations due to events beyond reasonable control, including natural disasters, government restrictions, or public health emergencies.

As a participant, you agree to:

• Provide accurate information about your physical fitness, medical conditions, and emergency contacts
• Follow all safety instructions provided by guides
• Wear provided safety equipment (life jackets, helmets when required)
• Arrive at designated meeting points on time
• Respect wildlife and natural environments
• Refrain from behavior that endangers yourself, other participants, or guides
• Inform us immediately of any health changes or concerns during the expedition
• Bring appropriate personal items as specified in pre-expedition communications

Participants must meet the following requirements:

• Reasonable physical fitness appropriate to the chosen expedition
• Ability to swim (or willingness to wear life jacket at all times)
• No medical conditions that could be exacerbated by kayaking activities without prior disclosure
• Pregnant participants must consult a physician before booking and provide medical clearance

We reserve the right to refuse participation to individuals whose health or behavior poses risks to themselves or others. In such cases, no refund will be provided.

Horizique maintains comprehensive liability insurance covering our operations. However, participants are responsible for:

• Personal travel insurance including medical coverage and emergency evacuation
• Coverage for personal belongings brought on expeditions
• Cancellation insurance if desired

We are not liable for:

• Injuries resulting from participant negligence or failure to follow instructions
• Loss or damage to personal property
• Costs arising from expedition changes due to weather or safety conditions
• Indirect or consequential losses

All content on our website and marketing materials, including text, images, logos, and route descriptions, are owned by Horizique or licensed to us. Participants may:

• Take photographs and videos for personal use during expeditions
• Share their experiences on social media with appropriate credit

We may use photographs or videos taken during expeditions for marketing purposes unless you specifically opt out in writing.

We reserve the right to modify expedition routes, schedules, or activities based on:

• Weather conditions and sea states
• Wildlife protection requirements
• Government regulations or park restrictions
• Safety assessments by our guides

Such modifications do not entitle participants to refunds unless the expedition is substantially different from what was booked.

Governing Law: These Terms and Conditions are governed by the laws of Malaysia.

Jurisdiction: Any disputes arising from these terms or your participation in our expeditions will be subject to the jurisdiction of Malaysian courts.

Informal Resolution: We encourage participants to contact us directly to resolve any concerns before pursuing formal action. Most issues can be addressed through open communication.

We may update these Terms and Conditions periodically. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes constitutes acceptance. Terms in effect at the time of your booking govern that specific expedition.
